We, Kitzsport GmbH, FN 467573 h, Kitzbühel district court, Wagnerstraße 17, 6370 Kitzbühel, perform all sales and deliveries exclusively on the basis of the following General Terms and Conditions of Business in the version that is valid at the time of the order in question unless we have agreed upon other conditions with the respective customer explicitly and in writing:

IMPORTANT NOTES
The goods we offer on our website are represented by digital photographs. Differences between that representation and the actual goods may be due to technical reasons and do not constitute any fault in the goods ordered from us. Please note that the goods presented at www.kitzsport.at may be out of stock or unavailable when you view the website. Any changes in price may not be reflected on our website yet.

CONTRACTUAL RELATIONSHIP
Please refer to our website for the essential characteristics of the products we offer. The information presented in our price lists, catalogues and on our websites are always non-binding. We reserve the right to alter that information at any time. Customer orders merely constitute an offer to conclude a contract with us. Only when we dispatch the product ordered from us does a sales contract come into force.

PRICES
All prices are stated in EUR and inclusive of statutory value-added tax (VAT). The VAT rate and share of the final sum are shown on the invoice.

DELIVERY
www.kitzsport.at dispatches all orders to the shipping address provided by the customer. We do not deliver to PO boxes.

WARRANTY
Statutory warranty regulations apply.

RIGHT OF WITHDRAWAL
Beginning of the cancellation policy
(1) Right of withdrawal for customers in Austria Where a contract of sale is concluded exclusively by means of telecommunication devices as described in Section 5a Paragraph 2 of the Austrian Consumer Protection Act (KSchG), the consumer has the right to withdraw their order within 30 working days (excluding Saturdays) of their receipt of the goods or order of the service without giving reasons either in writing (email, letter, fax) or by returning the goods. As per Section 5a Paragraph 2 Consumer Protection Act (KSchG), the consumer must receive a written confirmation of the information laid down in Section 5c Paragraph 1 Lines 1–6 in due course during the conclusion of the contract of sale for any goods not intended for resale to third parties, provided that said information has not been confirmed to the consumer in writing prior to the conclusion of the contract of sale. This written confirmation (provision of information) can also be provided to the customer as a permanent medium. As per Section 5e Consumer Protection Act, the withdrawal period starts once the customer receives that information but not before their receipt of the goods (in case of return shipments of similar goods, not before their receipt of the first partial delivery). If the obligation to inform has been violated as per Section 5d Paragraphs 1–2 Consumer Protection Act, the withdrawal period shall be extended to 3 months. If the provider complies with their obligation to inform within that period, the withdrawal period stipulated in Section 5a Paragraph 2 Consumer Protection Act (KSchg) starts when the provider transmits the information.

To observe the withdrawal period, the consumer only needs to send a cancellation notice in writing to:

The following circumstances are excluded from the right of withdrawal: contracts of sale involving products that have been customised to the consumer’s specifications and meet their unique, personal needs (especially products made to order, alterations etc.)

Contracts of sale involving services in conjunction with the purchased goods, service contracts that will be performed for the consumer within 7 days from the conclusion of the contract, contracts of sale involving software, provided that the delivered goods have been unsealed. Warranty extensions and expansions that have already been opened or registered.

Consequences of withdrawal

In the event of an effective withdrawal from a contract, all mutually provided receivables must be returned, and any profits drawn (e.g. interest) must be surrendered. If you are unable to return those receivables and profits (e.g. benefits of use) in whole or in part or only in a deteriorated condition, you must provide us with an appropriate value replacement. You are only liable to provide us with a value replacement for deteriorated goods and obtained profits if said deterioration or profits have arisen from use of the goods beyond that required to ascertain their nature and functioning. Ascertainment of the nature and functioning of an item refer to tests that are possible and generally carried out in a shop.

Consumers can avoid an obligation to provide a value replacement by refraining from operating the ordered item(s) as their property and from taking any action that may impair the value of said item(s). Section 5g Paragraph 2 Consumer Protection Act (KSchG) stipulates that the consumer shall bear the cost of the return shipment regardless of the value of the item being returned. In the event of a return, you shall cover the cost of the return shipment.

Any services that have already been performed and are therefore excluded from the right of withdrawal either reduce the purchase price to be refunded to the consumer or will be billed to the consumer and treated as an outstanding claim in the event of a refusal of acceptance.

PAYMENT TERMS
We accept the following payment methods. Please choose your preferred method. Shipping costs may vary depending on the payment method selected. The prices quoted in the various options are final. They include all price components including any taxes, such as VAT. Deliveries across borders may require you to pay additional taxes (e.g. in the event of intra-community shipments) or duties (e.g. customs duties) to the competent customs or tax authorities rather than the provider. The costs of delivery and handling charges are not included in the purchase price. Shipping prices can be accessed via the “Shipping Costs” page, are displayed separately during the ordering process, and must be borne by the consumer in addition to the sales price.

Instant banking is a convenient payment method with the following TÜV certificates: “certified data privacy” and “tested payment system.” It was developed by Payment Network AG and is used by many online shops in Germany. Using the secured payment form provided by Payment Network AG, which is not accessible to sellers, SOFORT makes a transfer to your online bank account automatically and in real time. The purchase price is transferred to the seller’s bank account directly and instantaneously. NOTE: Please observe the transaction fees during the order process.

RETENTION OF TITLE
The delivered goods remain the property of Kitzsport GmbH until full payment has been made.

PRIVACY
We only collect personal data which you disclose to us voluntarily when placing an order, opening a customer account or subscribing to our newsletter. We utilise those data without your explicit consent only to handle your order. Once your order has been handled and we have received your full payment, your personal data will be blocked for other usage and erased at the end of the period required by tax law and commercial law, provided that you have not agreed expressly the further use of your data. If you subscribe to our newsletter, we will use your email address for our own advertising interests until you unsubscribe. You can unsubscribe at any time.

VOLUNTARY RETURN POLICY
Kitzsport GmbH voluntarily provides you with the opportunity to return products purchased from us, regardless of your legal right of cancellation. Provided the goods are complete and in unused and undamaged condition, you can return all articles purchased from Kitzsport to us using the return receipt without giving a reason within 14 days of receiving the goods. You are only allowed to test the goods in the same manner you would e.g. try them on in a shop.

Goods labelled with a special hygiene sticker or equipped with a hygiene seal can only be returned if the sticker/seal has not been opened.
